General Terms and Conditions

 The conditions governing business dealings between the user and BELLART CARDOS (hereinafter BCNGOTIC APARTAMENTS) concerning all reservations managed via the www.bcngotic.com web page are established below.

 The contracting of services from BCNGOTIC APARTAMENTS, and/or the making of reservations from this website by the user implies the declaration of being of legal age as well as the express acceptance of the present "General Terms and Conditions" as well as the "Legal Notice" and "Privacy Policy", and thereby constitutes a valid contract between the two parties.

 Making a reservation via www.bcngotic.com:

 1.- Selecting Accommodation

 At our website www.bcngotic.com you can find a wide range of apartments, flats and/or houses for short term stays (hereinafter APARTMENTS).

 You have an APARTMENTS search facility where you can enter the dates and/or number of nights you want to stay. The list provided by the system shows you photographs of the places available, the number of people that can stay there and the approximate price.

 Bear in mind that the price that appears in the home page is a guideline and/or approximate, and can vary depending on the dates of your stay. We therefore ask you to please check the price once you have selected the entry and exit dates before going onto validate the reservation process, which is when the final applicable price appears.

 By clicking on the “more information” option you will find more information about the features of the selected APARTMENT, such as the area it is located in, fixtures and furnishings, photos, etc.

Once you have found the APARTMENT you want, click on “Reserve”.

 2.- Making the reservation

 Once you have clicked on the “Reserve” option, a window appears where you can check the availability of the APARTMENT and/or select the entry and exit dates. Remember that some APARTMENTS have a minimum stay period, which shall be shown in this window

 You must also select the number of people for whom the reservation is being made in this window.

 Bear in mind that OVERNIGHT STAYS OF MORE PEOPLE THAN THE NUMBER ENTERED IN THE RESERVATION IS PROHIBITED. In the case of non-fulfilment of this obligation, BCNGOTIC APARTAMENTS shall reserve the right to rescind the contract between the parties, and if necessary, claim compensation.

 Also bear in mind that when you arrive at the APARTMENT, you must hand over 200€ as a deposit. This shall be paid in cash and shall be returned to you when you leave the APARTMENT if no damage to the premises has occurred.

 Once you have selected the number of people, click on “add” and a summary of your reservation will appear with:

• Entry and exit dates
• Applicable price per night
• Total cost of your stay
• Amount payable as part of the total amount due for your reservation (normally 20%), payable via credit card to confirm your reservation
• Amount payable as deposit
•  VAT

 Bear in mind that this price includes the cleaning service on leaving, but does not include refuse disposal, which is the responsibility of the user and may be charged separately.

 If you agree with all the points and wish to validate your reservation, click on the “continue” option to show us your data and make the 20% confirmation payment of the reservation.

 If you do not agree with the reservation data, or want to change it and/or leave the process, click on the “cancel” option.

 3.- Request for user date and reservation confirmation

 If you decide to continue with the reservation displayed on the screen (see previous point), the system will request your details along with the arrival time.

 Before continuing you must read and accept the "Legal Notice", these "General Terms and Conditions" and the "Privacy Policy". Please read these sections in detail as they contain important information about the company, the conditions regulating and governing your business dealings with BCNGOTIC APARTAMENTS, as well as relevant information about your rights and the way your personal data is managed.

You must also indicate the expected time of arrival at the APARTMENT. ALL arrivals after 23.00 have a 20€ surcharge, which must be paid in cash at the time of arrival along with the deposit.

Once the requested data is entered on the form, and the "Legal Notice", "General Terms and Conditions" and "Privacy Policy" are accepted, and if you agree with the details of your reservation on the right hand side of the form, click on the "continue" option to pay your reservation.

 4.- Payment

 Once the reservation is accepted and your contact details are provided, the system requests a payment of 20% of the total cost of your stay as a reservation.

 You must pay the reservation at this moment using a credit care via our “TPV Virtual” platform. This is a secure payment system VERIFIED BY VISA that processes the result of the operation in real time. The operations communications are also protected through the “Secure Socket Layers (SSL)” Internet data encrypting protocol.

 You only need to enter the card number, expiration date and security number to make the payment. Once this is done, do not click on the “update” option on your navigator until payment confirmation appears.

 The rest of the amount due, along with the deposit and (if necessary) the payment required for arrivals after 23.00, must be paid in cash on arrival at the APARTMENT.

 5.- Confirmation of reservation

 Once payment is received, we shall send you an email confirming your reservation. Bear in mind that your reservation is not considered to be made until you receive the email confirming your payment from BCNGOTIC APARTAMENTS.

 6.- Cancellation and/or modification policy

 If you wish to cancel the reservation you made, you must inform us in writing by email at info@bcngotic.com or via fax at 933.104.155.

 A percentage of the amount due for return to you is made depending on when we are notified of the cancellation: 

• For cancellations with more than 60 days notice: 100% of the payment.
• For cancellations of between 30 and 60 days before arrival: 50% of the payment is returned;
• If cancellation is made less than 30 days before arrival: no money shall be returned. If the client changes the dates of entry and exit, it shall be regarded as a new reservation and the present cancellation policy shall be applied.

 Notwithstanding the above point, the user may abandon the reservation in a maximum period of 7 working days from the day of receipt of the reservation and 100% of the payment shall be returned.

 BCNGOTIC APARTAMENTS may not be able to offer the reserved APARTMENT at the time of your arrival for reasons beyond its control. If this were to occur, BCNGOTIC APARTAMENTS undertakes to provide you with a similar one with similar or better features.

 7.- Contact

 8.- Entry

 It is the responsibility of the user to contact BCNGOTIC APARTAMENTS 4 days before arrival either by email at info@bcngotic.com or by phone (+34.933.104.155 y +34.639.381.104), giving notice of the exact time of arrival, thus ensuring that someone will be there to hand over the keys.

 If there is a flight delay or similar hold up that might affect the arrival time, we ask you to contact us as soon as possible so that BCNGOTIC APARTAMENTS can make arrangements accordingly. If no contact is made, BCNGOTIC APARTAMENTS shall not be held liable for any discomfort or inconvenience caused by lateness in handing over the keys.

 9.- Exit

 Residents must leave the apartment before 11.00 am on the exit date.

When you leave the apartment, the deposit shall be returned to you when it has been confirmed that no damages were caused to the APARTMENT during your stay.

 10.- Cleaning

 When you arrive the APARTMENT will be clean. Remember that the price of your stay includes the cleaning service for the APARTMENT after you leave, although you must leave the apartment in a reasonable state and/or in a similar condition to the one in which you found it.

 The refuse disposal service is not included in the price, and is the responsibility of the user or guest.

 11.- Rules of behaviour

 The user/guest is responsible not only for his/her own behaviour, but also for the behaviour of the other occupants of the APARTMENT, and must remember the following rules:

• Bicycles may not taken up or down the stairs or lift or be left in the apartment or communal areas.
•  No activity that might affect normal coexistence between residents is permitted.
•  Hours of rest must be respected and no excessive noise must be made between 22.00 and 09.00 in the communal areas.
• Overnight stays in the apartment of more people than those entered in the reservation are strictly prohibited. If this rule is broken, the contract shall be immediately terminated and claims for compensation may also result.
•  Pets are not permitted.

 12.- Spelling errors in the website

 BCNGOTIC APARTAMENTS shall not be held liable for any possible typographical errors in its website www.bcngoticapartaments.com, concerning prices or any other information, and despite all efforts made by the company to ensure that there are no mistakes, it cannot guarantee that none appear in the website.
